TERMS & CONDITIONS

Please read carefully as they set out our respective rights and obligations

Tiger Adventure Tours Tasmania confirms your booking with the consent and trust of the payee or passenger to operate your selected tour on your behalf.
Tiger Adventure Tours Tasmania and the payee will engage in a contractual agreement as soon as the first payment has been received, at which time the terms and conditions set out below are to be abide by on all parties, supplier, payee and passenger.

(A) Bookings & Payment
1. Tiger Adventure Tours Tasmania uses an online booking software for which all bookings are to be processed through via our website www.tigeradventuretourstasmania.com.au
2. At the time of booking 50% of the total amount is required to confirm each booking.
3. You the payee have the option to pay 50% or 100% of the total booking price outside of the 48 hour booking period.
4. If bookings are made within 48hrs of departure date, a full payment will be required.
5. Cards accepted are Master card, Visa card and American Express. Surcharges are included in the total amount.
6. Your payment details will be held until the starting time of the tour at which time the remaining balance is paid automatically from your nominated bank.
7. You the payee give authority for Tiger Adventure Tours Tasmania and their staff to process the balance on the day of the tour.
8. On the day of the tour at which time the tour shall begin, final payment will be debited from your nominated account as per booking process.
9. Once initial payment is made, a confirmation email will be sent to your nominated email address. Please check all details and if in error please contact us as soon as possible.
10. We are not deemed liable for incorrect details entered, responding email address or tour dates. We will do our best to rectify any mistakes providing availability and time allowed to do so.
11. The nominated booking person is required to be 18 years or older and responsible for all payments for their requested booking.
12. Passengers under the age of 18 are to be accompanied with an adult.
13. Minimum age on tour is 7 years due to safety and the nature of our tours.

(B) Cancellations and Changes – By Customer
1. Cancellations in any form, verbal call, mobile texting, email are accepted.
2. Cancellations less than 48 hours prior to the beginning of the booked tour will incur a non refundable amount of 100% of the total purchase price.
3. Cancellations of greater than 48 hours will be refunded accordingly of the contractual amount and incur a cancellation fee of $30 per booking.
4. Cancelation when not attending the tour results in a 100% of the total contractual purchase price.
5. Tour dates can be altered with a fee of $30 per booking, up until 48 hours prior to the tours departure date providing availability on the requested date.
6. Rescheduled tours can not be rebooked where special discounted offers are made available.

(C) Cancellations and Changes – By Tiger Adventure Tours Tasmania
1. Tiger Adventure Tours Tasmania reserve the right at any time to cancel or alter the tours whereby your enjoyment and personal safety to you and those around you are jeopardised or put at risk.
2. In the case of a cancellation or changes made due to occurrences outside of our control such as but not limited to bushfires, flooding, total or partial road closures, extreme weather, dinning locations, vehicle breakdown, change of vehicle or personal health emergency, whereby the tour or partial tour can not be completed, passengers will be notified before each tour begins and refunded accordingly:
a. Cancellations made by Tiger Adventure Tours Tasmania outside of the required 48 hour notification period, a full 100% of the contractual amount will be refunded.
b. Cancelations made by Tiger Adventure Tours Tasmania inside the required 48 hour notification period, no refund will be issued.
3. We will however do our very best in communicating to the paying passenger(s) and to the public noting any cancellations or changes prior to the commencement of the effected tour(s) so as to remain informative and cooperative to the passengers of Tiger Adventure Tours Tasmania.

(D) Travelling
1. It is your responsibility to meet your tour guide at arranged locations, generally this is your accommodation. We will not be deemed liable for any reason when services are arriving or departing late and you are resulting in a missed connecting service. We will do our best to meet our arrival and departure times.
2. Times are approximate but we will do our best to be on time.
3. We do not offer pick up and drop off locations outside of Bicheno or Coles Bay area unless it is within the selected tour route. Eg. Binalong Bay tour, we will pick up from Coles Bay but not Swansea, we will pick up along the Tasman Hwy to Binalong Bay but not St Mary’s. If you require further information please don’t hesitate in making contact using the option provided.
4. Whilst you are in the company of Tiger Adventure Tours Tasmania you the passenger must obey the laws enforced by the state of Tasmania.
5. Consumption of alcohol within our 4×4 vehicle is not accepted. We ask the passenger(s) to drink responsibly.
6. Loud abusive behaviour will not be tolerated.
7. We ask that you the passenger to show respect to the diverse customs that exist in Tasmania and those that may be involved in the tour and within the tour group. Failing to do so you will be asked to surrender your place in the tour and your ticket will be cancelled without refund.
8. Your tour guide may need to make a decision in the interest of safety. It is the conditions of your booking that you comply with the authority and decision of the appointed guide. If you do not comply with these conditions and become incompatible with the general enjoyment and the well-being of members on the tour, the appointed guide reserves the right to refuse to allow you to continue the tour. In such a case Tiger Adventure Tours Tasmania will not be liable for any refund compensation or any additional cost incurred by you. We do not except liability for the behaviour of others on our tours.
9. The tour guide is acting in accordance with the laws of Tasmania and the guidelines set out by Tiger Adventure Tours Tasmania which adhere to the Passenger Transport Service Act 2011 and Responsible Service of Alcohol therefore the guides decision on any matter is final.

(E) Your Obligations and Responsibilities
1. You are required to inform Tiger Adventure Tours Tasmania of any dietary, medical or other conditions at the time of making your booking.
2. If your dietary or medical condition changes you can informs using our “contact us” form on our website www.tigeradventuretourstasmania.com.au, email, phone or text message.
3. You the passenger are required to sign an acknowledgement of prior risk. Failure to do so may result in cancellation of your participance and a forfeit of your, the passengers tour payments.
4. It is your responsibility to have all necessary visas, passports, permits and certificates required for your selected tour as Well as any necessary vaccinations and to comply with all applicable laws.
5. During the tour your guide may request to take photographs and film of you or as part of a group. These may be use in our brochures, advertising through public material and social media outlets. By signing the consent form provided at the beginning of the tour you give consent for such content to be taken and used where reasonably practicable and in a professional manner. No exchange of funds will be rewarded if used in any publication.
6. If you wish against then use of your photos for any publication, print, social media, please let this be known to your guide at the beginning of the tour and your request will be respected.
7. When you book with Tiger Adventure Tours Tasmania you except full responsibility for any damages or loss caused by you. Full payment for such damage or loss must be paid at the time requested. If you fail to do so you will be responsible for meeting any claims legal costs subsequently made against us as a result of your actions.
8. While on a Tiger Adventure Tours Tasmania tour you are obliged to follow all parks and wildlife guidelines, forestry guidelines, and conservation guidelines.
9. All passengers on tour are requested to respect the property of historical parks, parks and wildlife and conservation land, building, signs.
10. You the passenger are required to stay to the provided tracks, pathways and toilets in order to preserve the natural surroundings.
11. The Tasmanian way of life is one of enjoying life, relishing and respecting other people’s company. We invite you to join our tour with a positive frame of mind, ready to enjoy your adventure with us. At all times you must show courtesy and respect to your driver/guide and more importantly the other tour members. Failure to do so may result in you being asked to leave the tour at the guides discretion under the Passenger Transport Service Act 2011.

(F) Privacy Policy
1. Tiger Adventure Tours Tasmania is committed to providing quality services to you and our policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
2. Tiger Adventure Tours Tasmania Privacy Policy may change from time to time without your prior knowledge and is available on our website. Effective immediately once updated on the Tiger Adventure Tours Tasmania website.
3. If you have any queries or complaints about our Privacy Policy please make contact via our website or our email address provided.
4. A copy of the Australian Privacy Principles may be obtained from the website of The Office of the Federal Privacy Commissioner at www.privacy.gov.au.
5. You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions, e.g. client notes. If you wish to access your Personal Information, please contact us via email.

(G) Acknowledgement of Prior Risk
1. Tiger Adventure Tours Tasmania has done everything capable to minimise any risks endured during its tours. However it is an important requirement that all passengers are made aware and accept there maybe some risk involved in any activities whilst in the great outdoors on tour.
2. We, Tiger Adventure Tours Tasmania adhere to at the best of our knowledge the laws, first of Tasmania and second of the Commonwealth of Australia. Relevant legislation includes, in Tasmania, the Civil Liability Act 2002, the Motor Accidents Insurance Board Act and the Fair Trading Act and for the Commonwealth, the Competition and Consumer Act 2010.
3. If you are under the age of 18, the age at which you are deemed able to take responsibility for your own actions under Australian law, then this contract can only be made on your behalf by your parent or legal guardian.
4. I declare my response to the provided risk acknowledgement is correct and that I have not withheld any information or material in determining my ability to engage in my chosen tour. I agree to this release of claims, waiver of liability and knowledge of risks. I acknowledge I am responsible for my actions and the safety of others through my actions.
5. I waive any and all claims I may have against Tiger Adventure Tours Tasmania and release from all liability and agree not to sue Tiger Adventure Tours Tasmania, its offices, employees, guides, drivers, associated agents or representatives or the governing bodies for any personal injury, death, property damage or loss sustained by me as a result of my enrolment with Tiger Adventure Tours Tasmania.
6. I am aware that my chosen tour, in addition to the usual dangers and risks inherent throughout the tour have a certain additional danger and risk, some of which may include personal injury, damages to property remoteness to normal medical services and that evacuation difficulties have been considered.
7. I have informed Tiger Adventure Tours via the booking process of any medical condition, allergies or personal difficulties I have obtained prior to the tour.

(G) Customer Special Requests
1. Due to the remote nature of our business not all special requirements and requests can be met.
2. We allow people to be dropped off at a designated location other than the initial pick up point. This will only be available if the vehicle is booked out for a custom tour.
3. You may request for a custom or multi-day tour which allows you to customise an existing tour or create a personalised tour. Please request your interests using the contact option provided.

(H) Complaints
1. In the unlikely event that you may wish to make a formal complaint against Tiger Adventure Tours Tasmania, please inform your guide at the time. If the matter cannot be resolved immediately or during your trip after the guide endeavours to do so, your complaint should be made in writing to Tiger Adventure Tours Tasmania as soon as reasonably practicable but no later than 15 days thereafter the event. You will then receive
contact by the manager or legal associate of Tiger Adventure Tours Tasmania.
2. You will be assured of respect and courtesy whilst your complaint is being dealt with.
3. For all complaints and claims which do not involve death, personal injury or illness, we regret we cannot accept liability if you fail to notify the complaint or claim entirely in accordance with these terms and conditions. If you fail to follow this simple complaints
procedure, your right to claim any compensation you may otherwise have been entitled to may be affected or even forfeited as a result.

(I) General
1. The booking terms and conditions detailed herein contain the entire contract between you the payee / passenger and Tiger Adventure Tours Tasmania. No representation, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contract may only be varied in writing by a duly authorised personnel
of Tiger Adventure Tours Tasmania.
2. This contract and all matters arising out of it are governed by Tasmanian law, relevant legislation includes Passenger Transport Service Act 2011, The Civil Liability Act 2002, The Motor Accidents Insurance Board Act and The Fair Trading Act and for the Commonwealth, the Competition and Consumer Act 2010. We both (you and Tiger Adventure Tours
Tasmania) agree that any dispute, claim or other matter which arises out of or in connection with this contract or your holiday, will be dealt with by the courts of Australia.
3. Every effort is made to ensure the accuracy of our brochures and other printed material at time of going to print, however Tiger Adventure Tours Tasmania cannot be held responsible for printing and typographical errors, or errors arising from unforeseen circumstances.

(J) Refunds
1. Any refund where both parties agree to the terms and conditions and have been adhered to, a refund will be processed.
2. All refunds must be agreed by Tiger adventure Tours Tasmania management.
3. Refunds will be deposited into your nominated account within 28 business days. Please be aware that refunds may take longer to appear on your bank statement.

(K) Smoking
1. There is a no smoking policy for all Tiger Adventure Tour Vehicles. We do not allow smoking within our vehicles.
2. Any smoking to be taken in the outdoors not be in a 5 meter radius of any food products, food preparation or eating location.
3. All smoking must be in compliance with fire warnings issued by state police, Parks & Wildlife or Tasmanian Fire Department.

(L) Insurance
1. There is no insurance cover included within the price of the ticket.
2. We, Tiger Adventure Tours Tasmania, which included all staff, driver, guides, chefs and affiliated persons, take no responsibility for any injury or loss incurred whilst partaking in our tour(s).
3. We suggest you register for insurance that covers tours of this nature, loss or damages to personal belongings, theft, cancellations, medical and public liability.
4. Tiger Adventure Tours Tasmania has various insurance covers that relate to the running of the business and is required by law within the state of Tasmania and third party entities.
